PupiLUX by R.Tej Health Analytics

This End User License Agreement ("EULA") is a legal agreement between you ("End User" or "you") and R.Tej Health Analytics ("Developer," "we," "us," or "our"), with its registered office at A-125 New Friends Colony, New Delhi 110025, India, for the use of the PupiLUX application ("Licensed Application" or "the App").

By downloading, installing, or using PupiLUX, you agree to be bound by these terms. If you do not agree, do not download, install, or use the App.

IMPORTANT NOTICE: PupiLUX is NOT a medical device. It is NOT cleared, approved, or registered by the U.S. Food and Drug Administration (FDA), the European Medicines Agency (EMA), the Central Drugs Standard Control Organisation (CDSCO), or any other regulatory body. PupiLUX is a quantitative measurement and screening tool that provides pupillometry data for informational purposes only. It does not diagnose, treat, cure, or prevent any disease or medical condition. All clinical decisions must be made by a qualified medical professional using their own independent clinical judgment.

1. Acknowledgement

You and R.Tej Health Analytics acknowledge that this EULA is concluded between you and R.Tej Health Analytics only, and not with Apple Inc. ("Apple"). R.Tej Health Analytics, not Apple, is solely responsible for the Licensed Application and the content thereof. This EULA may not include terms that conflict with the Apple Media Services Terms and Conditions ("Apple Terms").

2. Scope of License

R.Tej Health Analytics grants you a limited, non-exclusive, non-transferable, revocable license to use the Licensed Application on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Terms. This license does not allow you to use the Licensed Application on any device you do not own or control, and you may not distribute or make the Licensed Application available over a network where it could be used by multiple devices at the same time, except as permitted by Apple's Family Sharing or volume purchasing features.

3. Intended Use and Restrictions

PupiLUX is intended for use by qualified medical professionals only, including but not limited to physicians, nurses, and paramedics. By using the App, you represent that you are a licensed healthcare provider or are using the App under the direct supervision of one.

You agree that:

You will use PupiLUX solely as a supplementary measurement and screening tool, and not as a substitute for professional clinical assessment, established diagnostic protocols, or standard-of-care practices.
You will not use PupiLUX measurements as the sole basis for any clinical decision, diagnosis, or treatment plan.
You will interpret all measurements in the context of a complete clinical evaluation, patient history, and other diagnostic tests.
You will not modify, reverse-engineer, decompile, or disassemble the Licensed Application.

4. Not a Medical Device

PupiLUX does NOT diagnose any medical condition. The pupillometry measurements, scores, and indices provided by PupiLUX — including the Pupil Reactivity Index (PRI), Relative Afferent Pupillary Defect (RAPD) estimate, and all associated metrics — are quantitative data points only. They do not constitute a diagnosis, medical advice, or treatment recommendation. The interpreting clinician bears full responsibility for any clinical decisions.

PupiLUX has not been evaluated, cleared, approved, or registered by the U.S. Food and Drug Administration (FDA), the UK Medicines and Healthcare products Regulatory Agency (MHRA), the Central Drugs Standard Control Organisation (CDSCO), or any other regulatory authority. It is not classified as a medical device under any jurisdiction. You should always consult a qualified healthcare professional and rely on established clinical protocols when making medical decisions.

5. Credit System and In-App Purchases

PupiLUX operates on a prepaid credit model. Each pupillometry test consumes one credit.

Free credits: Each new installation receives 100 free test credits.
Purchased credits: Additional credits may be purchased through Apple's In-App Purchase mechanism. All credit purchases are processed by Apple and are subject to Apple's terms and refund policies.
No expiry: Purchased credits do not expire, in accordance with Apple's App Store guidelines.
Consumable: Credits are consumed upon use and cannot be restored, transferred between devices, or recovered once used.
Device-bound: Credits are associated with the device on which they were purchased or granted and cannot be transferred to another device.
Refunds: Refund requests for In-App Purchases must be directed to Apple, as Apple processes all payments. R.Tej Health Analytics does not process payments or issue refunds directly.

6. Data Collection and Privacy

By accepting these terms, you acknowledge that PupiLUX may collect anonymized, non-identifiable test metrics when data sharing is enabled. This data is used solely to build normative reference ranges and improve pupillometry accuracy. No personally identifiable information, patient data, or biometric images are ever collected or transmitted.

All pupil analysis, including video capture and metric computation, happens entirely on your device.

7. Maintenance and Support

R.Tej Health Analytics is solely responsible for providing any maintenance and support services with respect to the Licensed Application, as described in this EULA or as required under applicable law. You and R.Tej Health Analytics acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.

8. Warranty Disclaimer

The Licensed Application is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

Pupillometry measurements may be affected by ambient lighting conditions, patient cooperation, camera quality, phone positioning, and other environmental factors. R.Tej Health Analytics does not warrant that measurements will be error-free or that the App will operate without interruption.

PupiLUX provides annotations of eye images to give you an estimate of the AI's detection capability for each patient. These annotations are indicative only and may not reflect ground truth. Please exercise your own clinical judgment when interpreting annotated images and all associated measurements.

In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Licensed Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be R.Tej Health Analytics' sole responsibility.

9. Limitation of Liability

To the maximum extent permitted by applicable law, R.Tej Health Analytics and its officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:

Your use of or inability to use the Licensed Application
Any clinical decisions made based on measurements provided by the App
Errors, inaccuracies, or omissions in the measurements
Any interruption, suspension, or termination of the service
Any unauthorized access to or alteration of your data

In no event shall R.Tej Health Analytics' total aggregate liability exceed INR 1,000 (Indian Rupees One Thousand only), regardless of the amount you may have paid for the Licensed Application or any In-App Purchases.

10. Product Claims

You and R.Tej Health Analytics acknowledge that R.Tej Health Analytics, not Apple, is responsible for addressing any claims you or any third party may have relating to the Licensed Application or your possession and/or use of the Licensed Application, including but not limited to:

Product liability claims
Any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement
Claims arising under consumer protection, privacy, or similar legislation

11. Intellectual Property

You and R.Tej Health Analytics acknowledge that, in the event of any third-party claim that the Licensed Application or your possession and use of the Licensed Application infringes that third party's intellectual property rights, R.Tej Health Analytics, not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of any such intellectual property infringement claim.

12. Legal Compliance

You represent and warrant that:

You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country.
You are not listed on any U.S. Government list of prohibited or restricted parties.
You will comply with all applicable local, state, national, and international laws and regulations in connection with your use of the Licensed Application.

13. Third-Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using the Licensed Application. This includes, without limitation, your wireless data service agreement and the Apple Media Services Terms and Conditions.

14. Third-Party Beneficiary

You and R.Tej Health Analytics acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.

15. Governing Law

This EULA shall be governed by and construed in accordance with the laws of India. Any disputes arising from this EULA or your use of PupiLUX shall be subject to the exclusive jurisdiction of the courts of New Delhi, India, without regard to conflict of law principles.

16. Termination

This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the Licensed Application and destroy all copies in your possession. Sections 4, 8, 9, 10, 11, 14, and 15 shall survive any termination of this EULA.

17. Changes to This Agreement

We may update this EULA from time to time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the App after any changes constitutes acceptance of the revised EULA. Material changes will be communicated through the App or via email where possible.
